What the Consumer Protection Act (CPA) Means to You
Like the National Credit Act established the National Consumer Tribunal, the CPA establishes the National Consumer Commission which enforces the provisions of the CPA and protects consumers.
Who does the CPA protect?
Any person acting personally or in a representative capacity may approach a court, the National Consumer Tribunal or the National Consumer Commission to allege that a consumer right entrenched in the CPA has been infringed.
What does the CPA Regulate?
The CPA regulates the goods and services industries.
In terms of the CPA you have the right to receive goods that are reasonably suitable for the purposes for which they were intended, of good quality, in good working order and free of any defects, and will be usable and durable for a reasonable period of time, having regard to the use to which they would normally be put. If any defects in the goods sold come to light, you have up to 6 months from the sale to return the goods and ask for a full refund or, in the alternative, to ask the seller to repair or replace the goods, to comply with the expectations set out above.
